Terms of Service
These terms govern access to and use of the HarmonyWFM platform by customers and their authorized users.

1. Agreement
These Terms of Service form an agreement between HarmonyWFM ("we", "us") and the organization that subscribes to the platform ("Customer"). Where a signed service agreement or order form exists, that document controls if it conflicts with these terms.
2. Accounts and authorized users
Customer is responsible for maintaining the confidentiality of account credentials, for the activity of its authorized users, and for ensuring that employee records entered into the platform are accurate. Customer administrators control role assignment and access within their workspace.
3. Subscriptions and fees
Subscriptions are billed per employee per month (PEPM) plus any enabled modules and platform fees, as stated in the applicable order form or service agreement. Unless the order form says otherwise, invoices are due on the terms shown on the invoice, and fees are non-refundable once the billing period has begun.
4. Acceptable use
Customer will not use the platform to violate law, infringe rights, transmit malware, probe or breach security or tenancy boundaries, resell access without authorization, or reverse engineer the service. We may suspend access to address an active security or integrity risk, and will notify Customer when we do.
5. Customer data
Customer retains all rights to the data it submits. We process that data to provide and support the service, as described in the Privacy Policy and the Data Processing Addendum. We do not sell Customer data.
6. Not legal, payroll, or tax advice
The platform provides calculation and record-keeping tools, including overtime, accrual, and attendance-points computations that Customer configures. Customer is responsible for confirming that its configuration meets applicable wage-and-hour, leave, and employment laws. Outputs are not legal, payroll, or tax advice.
7. Availability and support
We aim to keep the service continuously available and perform maintenance with as little disruption as practical. Any committed uptime levels, support response targets, or service credits apply only if they are stated in a signed service agreement.
8. Term and termination
Subscriptions continue for the term stated in the order form and renew as described there. Either party may terminate for material breach that remains uncured after written notice. On termination, Customer may export its data during the period described in the Data Processing Addendum, after which we delete it in the ordinary course.
9. Warranties and liability
Except as expressly stated in a signed agreement, the service is provided "as is" without warranties of any kind. To the extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the fees paid for the twelve months preceding the claim.
10. Changes
We may update these terms as the service evolves. Material changes will be posted on this page with a new effective date and, for active subscriptions, communicated to the Customer's administrative contacts.
